These General Terms and Conditions of Sale (hereinafter the "GTC") define the rights and obligations of the parties in the context of the online sale of products offered on the website. www.https://tapiroma.com/en/module/dgtranslationall/urlstranslation, edited and operated by CUIROMA GROUP SARL.

Tapiroma.com is an international brand specializing in the design, handmade production, and marketing of Moroccan rugs, handmade rugs, Berber rugs, Beni Ourain rugs, Azilal rugs, Mrirt rugs, Kilim rugs, custom rugs, artisanal poufs, cushions, and decorative items made in Morocco.

All creations are handmade in our workshops located in Fès, Morocco, by skilled artisans who carry on a traditional craft passed down from generation to generation.

These General Terms and Conditions of Sale apply to all sales made on the Site as well as to orders placed by individuals or professionals, unless otherwise agreed in writing.

Any order implies full, complete, and unconditional acceptance of these General Terms and Conditions of Sale.


ARTICLE 1 — PURPOSE

These General Terms and Conditions of Sale are intended to define the conditions under which CUIROMA GROUP SARL markets its handcrafted products to its customers through the website. www.https://tapiroma.com/en/module/dgtranslationall/urlstranslation.

They specify in particular:

  • the ordering terms ;
  • the manufacturing conditions ;
  • the prices ;
  • the payment terms ;
  • the delivery conditions ;
  • the guarantees ;
  • Returns and refunds ;
  • the responsibilities of the parties ;
  • the applicable law.

These Terms and Conditions apply to all orders placed on the Site, regardless of the customer's country of residence, subject to the mandatory provisions applicable in their country.

In the event of a conflict between these General Terms and Conditions and any specific conditions agreed upon in writing, the latter shall prevail.


ARTICLE 2 — PRODUCTS

Tapiroma.com exclusively markets handcrafted artisanal creations made in Morocco.

The Site notably offers:

  • Handmade Moroccan rugs
  • Berber rugs
  • Beni Ourain Rug
  • Azilal Rug
  • Mrirt Rug
  • Kilim Rug
  • Custom-made carpet
  • Genuine leather poufs
  • Wool poufs
  • Handcrafted cushions
  • Moroccan handcrafted decoration

Each creation is individually made by skilled artisans using traditional manufacturing methods.

No industrial or mass-produced product is offered for sale.

2.1 Handmade Production

Each rug, pouf, cushion, or decorative item is handcrafted.

Due to this handcrafted production, each creation is unique.

Manufacturing times vary depending on the complexity of the product and the production load of our workshops.

2.2 Natural Variations

Handmade products may exhibit natural variations, particularly concerning:

  • the dimensions ;
  • the colors ;
  • the patterns ;
  • textures ;
  • fringes ;
  • weaving ;
  • the finish.

These variations are inherent to artisanal work and do not constitute a manufacturing defect or non-compliance.

2.3 Natural materials

The creations offered on Tapiroma.com are made from carefully selected natural materials, including:

  • natural wool ;
  • virgin wool ;
  • cotton ;
  • genuine leather ;
  • natural fibers ;
  • handmade dyes.

Slight differences in shade, texture, or appearance may occur from one product to another due to the inherent characteristics of the natural materials used.

2.4 Custom and Personalized Products

Some products can be custom-made or personalized according to the customer's requests.

Dimensions, colors, patterns, or finishes can be customized within the limits of manufacturing technical possibilities.

Any validation of a customized or tailor-made order definitively commits the customer.

2.5 Photographs and Product Representation

The photographs, videos, illustrations, and visuals published on the Site are provided for informational purposes only.

Despite the care taken in their creation, minor differences may exist between the displayed visuals and the delivered product due in particular to:

  • screen settings ;
  • shooting conditions ;
  • natural variations in materials ;
  • of the entirely handcrafted nature of the production.

These differences cannot be considered a defect in conformity.


ARTICLE 3 — PRICE

The prices displayed on Tapiroma.com are expressed in the currency selected by the customer (EUR, USD, GBP, or any other currency available on the Site).

The displayed prices do not include any potential delivery fees, local taxes, customs duties, or import charges applicable in the destination country.

The delivery fees are indicated before the final confirmation of the order.

CUIROMA GROUP SARL reserves the right to change its prices at any time.

However, the products are billed based on the rates in effect at the time the order is confirmed.

In the event of a clear pricing error resulting from a technical malfunction, the company reserves the right to cancel the order after informing the customer and to proceed with a full refund of any amounts paid.

Promotions, discounts, or promotional codes are only applicable under the conditions specified at the time of their distribution and cannot be combined unless otherwise indicated.


ARTICLE 4 — ORDERS

Any order placed on Tapiroma.com constitutes a firm purchase offer from the client.

The order becomes final only after:

  • payment validation ;
  • the acceptance of the order by CUIROMA GROUP SARL.

An order confirmation is sent to the customer by email.

As the products are handcrafted, their production begins after the order is confirmed.

4.1 Manufacturing lead times

The average manufacturing time is generally between 21 and 30 working days, depending on the product ordered, its complexity, the quantities requested, and the activity of our workshops.

During periods of high activity, this delay may exceptionally be extended.

The manufacturing time does not constitute a delivery delay.

4.2 Order Modification

Any request for modification must be made as soon as possible.

A modification can only be accepted if production has not yet begun.

Once production has started, no changes can be guaranteed.

4.3 Order Cancellation

An order can only be canceled as long as its production has not started.

Orders for personalized or custom-made products cannot be canceled after confirmation.


ARTICLE 5 — PAYMENT

Payment is due in full at the time of order confirmation.

All transactions are carried out through secure payment providers using encryption protocols that comply with international standards.

Depending on the client's country of residence, several payment methods may be offered, including:

  • Visa
  • Mastercard
  • American Express (if available)
  • PayPal
  • Bancontact
  • iDEAL
  • Giropay
  • EPS
  • MyBank

5.1 Payment Security

CUIROMA GROUP SARL never has access to its clients' confidential banking data and does not retain it at any time.

5.2 Refusal or failure of payment

In the event of payment refusal, bank authorization denial, suspected fraud, or inability to collect the amounts due, the order may be suspended, canceled, or refused without CUIROMA GROUP SARL being held liable.

5.3 Name appearing on the bank statement

Depending on the payment method used, the transaction may appear under the name CUIROMA GROUP, PAYPAL, or under the name of the relevant payment provider.


ARTICLE 6 — HANDMADE PRODUCTION

All the creations offered on Tapiroma.com are entirely handmade in the workshops of CUIROMA GROUP SARL, located in Fès, Morocco.

Each product is individually crafted by skilled artisans using traditional techniques passed down from generation to generation.

No industrial manufacturing or mass production is used.

The rugs, poufs, cushions, and decorative items are made to order or in very small artisanal batches to ensure their authenticity and quality.

6.1 Manufacturing lead times

The average manufacturing lead time is generally between 21 and 30 business days.

This timeframe may vary depending on:

  • the type of product ;
  • the dimensions ;
  • the complexity of manufacturing ;
  • the requested customizations ;
  • the production workload of the workshops.

The indicated deadlines are provided for informational purposes only.

6.2 Quality Control

Before any shipment, each creation undergoes a quality control process focusing in particular on:

  • the compliance of the dimensions ;
  • the quality of the materials ;
  • the handcrafted finishes ;
  • the strength of the seams or the weaving ;
  • the compliance of the order.

6.3 Unique pieces

Due to their artisanal craftsmanship, each creation is unique.

Slight differences in color, texture, weaving, patterns, dimensions, or finishing may exist and are a normal characteristic of handcrafted products.

These differences cannot be considered manufacturing defects.


ARTICLE 7 — INTERNATIONAL DELIVERY

Tapiroma.com delivers its creations to the majority of countries worldwide.

Shipments are entrusted to reputable international carriers.

The main carriers used include:

  • DHL Express
  • FedEx International Priority
  • UPS Express (depending on the destinations)
  • Any other carrier selected by CUIROMA GROUP SARL when necessary.

The delivery times start to run only after the completion of manufacturing.

The average delivery time is usually between 2 and 4 business days after shipping.

7.1 Delivery fees

Shipping fees are calculated based on:

  • of the destination country ;
  • of weight ;
  • dimensions ;
  • from the selected carrier.

They are displayed before the final confirmation of the order.

7.2 Order Tracking

Each shipped order is provided with a tracking number communicated to the customer by email.

The customer can track the delivery of their package directly on the carrier's website.

7.3 Delivery address

The customer is solely responsible for the accuracy of the information provided during the order.

Any error concerning the address, name, phone number, or any other information necessary for delivery is the responsibility of the customer.

Any reshipment may incur additional charges at the customer's expense.

7.4 Delivery Delays

Delivery times are provided for informational purposes only.

CUIROMA GROUP SARL cannot be held responsible for delays resulting in particular from:

  • carriers ;
  • customs authorities ;
  • security checks ;
  • weather conditions ;
  • of natural disasters ;
  • of social conflicts ;
  • from any event beyond its control.

7.5 Proof of delivery

The tracking information provided by the carrier, as well as the proof of delivery, constitute valid evidence of the successful completion of the delivery.

7.6 Refused or Unclaimed Packages

When a package is refused by the customer or is not claimed within the allotted time by the carrier, any return, storage, or reshipping fees may be deducted from the refund.

The initial shipping fees remain non-refundable.


ARTICLE 8 — TAXES, VAT AND CUSTOMS DUTIES

International orders may be subject to customs duties, local VAT, import taxes, or other fees imposed by the authorities of the destination country.

These fees are not included in the product price or the delivery charges, unless otherwise stated.

They remain solely the responsibility of the client.

The customer is responsible for informing themselves about the regulations applicable in their country before placing any order.

Some shipments may be subject to customs inspections that could result in additional delays beyond the control of CUIROMA GROUP SARL.

The refusal to pay taxes or fees required by local authorities cannot engage the responsibility of CUIROMA GROUP SARL.


ARTICLE 9 — RETURNS AND REFUNDS

Customer satisfaction is a priority for CUIROMA GROUP SARL.

Any return request must be addressed to customer service before sending the product back.

9.1 Non-conforming or defective products

A return may be accepted notably in the following cases:

  • product received damaged during transport ;
  • order preparation error ;
  • proven manufacturing defect ;
  • Product clearly not in accordance with the order.

Depending on the circumstances, the client may benefit from:

  • a replacement ;
  • a repair when it is possible ;
  • of a full or partial refund.

9.2 Products Excluded from Returns

Returns are not accepted, particularly in the following cases:

  • change of mind ;
  • dimension selection error ;
  • color choice error ;
  • model selection error ;
  • normal wear ;
  • damages resulting from improper use ;
  • Natural variations related to artisanal work.

9.3 Return Procedure

Any request must be accompanied by photographs or videos that clearly identify the issue encountered.

No returns can be made without prior agreement from CUIROMA GROUP SARL.


ARTICLE 10 — RIGHT OF WITHDRAWAL

When the applicable legislation grants the consumer a right of withdrawal, it may be exercised in accordance with the legal provisions in force.

However, in accordance with applicable regulations, the right of withdrawal does not apply, in particular, to products:

  • made to order ;
  • custom-made ;
  • customized according to the client's requests ;
  • specifically made for a client.

When the right of withdrawal applies, the product must be returned in its original condition, unused, clean, and accompanied by all its accessories as well as its original packaging, when reasonably possible.

Any potential refund will be made using the same payment method that was used for the order, subject to compliance with these General Terms and Conditions of Sale.

In the event of product depreciation resulting from handling other than that necessary to verify its nature, characteristics, or proper functioning, a proportional deduction may be applied in accordance with applicable regulations.


ARTICLE 11 — WARRANTIES

The products marketed on Tapiroma.com are made using traditional artisanal methods and undergo quality control before shipment.

CUIROMA GROUP SARL guarantees that the delivered products conform to the order validated by the customer, subject to the natural variations inherent in any artisanal manufacturing.

11.1 Warranty of conformity

In the event of a confirmed non-compliance or manufacturing defect, the customer is invited to contact customer service as soon as possible so that an appropriate solution can be offered.

Depending on the nature of the issue identified, CUIROMA GROUP SARL may notably offer:

  • the replacement of the product ;
  • the repair when it is possible ;
  • a full or partial refund ;
  • any other amicable solution suitable for the situation.

11.2 Warranty Exclusions

The warranty does not cover, in particular:

  • natural variations in dimensions ;
  • the differences in shades ;
  • variations in weaving or patterns ;
  • normal wear and tear ;
  • damages resulting from misuse ;
  • damage caused by improper maintenance ;
  • the damages caused after delivery.

The characteristics inherent to natural materials and artisanal craftsmanship cannot be considered defects.


ARTICLE 12 — LIABILITY

CUIROMA GROUP SARL makes every effort to ensure the quality of its products and the proper functioning of the Site.

However, its liability cannot be incurred in the cases provided for in these General Terms and Conditions of Sale.

12.1 Client Responsibility

The client is solely responsible:

  • information provided during the order ;
  • of the choice of ordered products ;
  • dimension verification ;
  • of the use of the products ;
  • respect for maintenance advice.

12.2 Limitation of Liability

Within the limits permitted by applicable law, CUIROMA GROUP SARL cannot be held liable, in particular:

  • delays attributable to the carriers ;
  • delays related to customs authorities ;
  • interruptions of the Site ;
  • indirect losses ;
  • operating losses ;
  • non-material damages ;
  • events of force majeure.

The total liability of CUIROMA GROUP SARL is, in all cases permitted by law, limited to the amount actually paid by the customer for the relevant order.

12.3 Force majeure

Neither party shall be held liable when an event beyond its control completely or partially prevents the fulfillment of its obligations.

Cases considered as force majeure include, in particular: natural disasters, fires, floods, pandemics, armed conflicts, terrorist acts, major cyberattacks, strikes, interruptions of communication networks, decisions by public authorities, customs blockades.


ARTICLE 13 — PERSONAL DATA

The personal data collected in the context of orders is processed in accordance with:

  • According to Moroccan law No. 09-08 relating to the protection of personal data ;
  • to the General Data Protection Regulation (GDPR) when it is applicable ;
  • in the UK GDPR when it is applicable ;
  • To any other mandatory regulations applicable according to the client's country.

The data is used solely for:

  • delivery ;
  • customer service management ;
  • fraud prevention ;
  • accounting, tax, and legal obligations.

Personal data is never sold to third parties.

13.1 Electronic Communications

By placing an order, the customer agrees to receive information related to their order electronically, including:

ARTICLE 14 — INTELLECTUAL PROPERTY

All the elements present on Tapiroma.com, In particular, the Tapiroma brand, logos, photographs, videos, illustrations, texts, descriptions, catalogs, graphic creations, designs, databases, layouts, software, as well as any other content published on the Site, remain the exclusive property of CUIROMA GROUP SARL or their respective holders.

Any reproduction, representation, adaptation, translation, distribution, extraction, or exploitation, in whole or in part, without prior written authorization is strictly prohibited and may result in legal action in accordance with applicable intellectual property laws.

15.1 Claim

ARTICLE 16 — APPLICABLE LAW, JURISDICTION, AND FINAL PROVISIONS

These General Terms and Conditions of Sale are governed by Moroccan law.

When mandatory provisions of the consumer's country of residence offer more favorable protection, these provisions shall remain applicable to the extent provided by the relevant legislation.

16.1 Amicable Resolution

In the event of a dispute, the parties agree to prioritize seeking an amicable solution before any legal proceedings.

16.2 Competent Jurisdiction

In the absence of an amicable agreement, any dispute relating to the interpretation, execution, or validity of these General Terms and Conditions of Sale shall fall under the jurisdiction of the courts of Fès (Morocco), subject to the mandatory provisions applicable to consumers in their country of residence.

16.3 Contractual Language

These General Terms and Conditions of Sale may be translated into several languages. In case of any discrepancy in interpretation between the different language versions, the French version shall prevail, unless otherwise required by mandatory legal provisions.

16.4 International Sales

The products offered on Tapiroma.com are intended for an international clientele and can be shipped to many countries. These General Terms and Conditions of Sale apply to all sales made on the Site, subject to mandatory provisions applicable in the customer's country of residence.
